Please read these Terms carefully before using dunefox.io. By accessing or using our website, you confirm that you accept these Terms and agree to comply with them. If you do not agree, you must not use our website or services.

1. Parties and Agreement

These Terms of Service ("Terms") govern your access to and use of the website located at dunefox.io (the "Website") and any related services made available on the Website (collectively, the "Services"), provided by Sucetas Technologies UK Ltd ("Dunefox", "we", "us", "our"), a company incorporated in England and Wales under company number 16984447, with its registered office at:

2nd Floor College House, 17 King Edwards Road, Ruislip, London, United Kingdom, HA4 7AE

These Terms constitute a legally binding agreement between you ("User", "you", "your") and Dunefox. References to "you" include the company or legal entity you represent if you are accessing the Website on behalf of a business.

Separate terms govern the use of our software platform at app.dunefox.io, which are presented and agreed to at the time of account registration.

2. Our Services

dunefox.io is a marketing and information website that provides:

  • Information about Dunefox's AI-powered business platform for customer support, lead management, and marketing automation;
  • A demo AI chatbot experience that uses a URL you provide to demonstrate Dunefox's capabilities;
  • Contact and sales enquiry forms;
  • Blog articles and educational content;
  • General information about pricing, features, and use cases.

We reserve the right to modify, suspend, or discontinue any part of the Services at any time without notice. We will not be liable to you or any third party for any such modification, suspension, or discontinuation.

By using this Website, you represent and warrant that:

  • You are at least 18 years of age;
  • You have the legal capacity to enter into a binding agreement;
  • If acting on behalf of a company or organisation, you have authority to bind that entity to these Terms;
  • Your use of the Website does not violate any applicable laws or regulations in your jurisdiction.

4. Acceptable Use

You agree to use the Website only for lawful purposes and in a manner that does not infringe the rights of others. You must not:

  • Use the Website in any way that violates any applicable local, national, or international law or regulation;
  • Submit any content or data that is fraudulent, misleading, defamatory, obscene, or otherwise unlawful;
  • Introduce viruses, trojans, worms, or other harmful or disruptive material;
  • Attempt to gain unauthorised access to any part of the Website, its servers, or any systems connected to the Website;
  • Use automated tools (scrapers, bots, crawlers) to extract data from the Website without our prior written consent;
  • Use the demo chatbot service to process data relating to individuals without their knowledge or consent;
  • Impersonate any person or entity or misrepresent your affiliation with any person or entity;
  • Engage in any conduct that restricts or inhibits anyone's use or enjoyment of the Website.

We reserve the right to suspend or terminate your access to the Website immediately if we reasonably believe you are in breach of these Terms.

5. Demo Chatbot Service and Data Submission

The Website offers a demo AI chatbot feature. When you use this feature, you:

  • Provide us with a website URL, which we use to demonstrate our AI service;
  • Acknowledge that we will crawl and analyse the content of the URL you submit solely for the purpose of the demonstration;
  • Warrant that you own or have the right to submit the URL and that doing so does not breach any third-party rights;
  • Understand that any lead data generated via the demo chatbot (names, emails, phone numbers of demo visitors) is collected and stored by us and that visitors to the demo are informed accordingly.

The demo service is provided on an "as is" basis for evaluation purposes only. Results from the demo do not guarantee the performance of a live Dunefox deployment.

To the fullest extent permitted by English law:

  • Dunefox shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of data, loss of business, or loss of goodwill, arising from your use of or inability to use the Website;
  • Our total aggregate liability to you for any claim arising out of or in connection with these Terms or your use of the Website shall not exceed £100 (one hundred pounds sterling);
  • We are not responsible for the content of any external websites linked from dunefox.io.

Nothing in these Terms shall limit or exclude our liability for: (a) death or personal injury caused by our negligence; (b) fraud or fraudulent misrepresentation; (c) any other liability that cannot be excluded or limited by law.

If you are a consumer (i.e. acting outside the course of a business), you may have statutory rights that these Terms cannot exclude or limit. Nothing in these Terms affects those statutory rights.

10. Indemnification

12. Privacy and Data Protection

Your use of the Website is subject to our Privacy Policy and Cookie Policy, which are incorporated into these Terms by reference. By using the Website, you consent to the processing of your personal data as described in those policies.

Where you provide us with personal data relating to third parties (e.g. in the course of setting up the demo), you represent that you have obtained all necessary consents and have a lawful basis for sharing that data with us.

13. Changes to These Terms

We may revise these Terms at any time by updating this page. The revised Terms will be effective from the date indicated at the top of this page. Your continued use of the Website after any changes are made constitutes your acceptance of the new Terms. We recommend you check this page periodically.

These Terms and any dispute or claim arising out of or in connection with them (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of England and Wales.

Each party irrevocably agrees that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms or their subject matter or formation.

If you are a consumer resident in Scotland or Northern Ireland, you may also bring proceedings in the courts of your country of residence.

15. Severability and Waiver

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions.

Our failure to enforce any provision of these Terms shall not constitute a waiver of our right to enforce that provision in the future.

16. Entire Agreement

These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and Dunefox with respect to your use of dunefox.io and supersede all prior or contemporaneous communications and proposals, whether electronic, oral, or written.
